1. Acceptance of Terms
By accessing or using MyAnimalTransport.com, AniPort, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a binding agreement between you ("User," "Shipper," "Transporter," or "Receiver") and High Desert Collective LLC, doing business as My Animal Transport and AniPort ("Company," "we," "us," or "our"), headquartered in Maricopa County, Arizona.
2. Role of the Platform
The Platform operates solely as a neutral online marketplace where shippers may connect with independent transport providers and receivers may accept delivery of animals. We are not a carrier, transporter, broker, insurer, agent, or guarantor of services. We do not directly transport animals, nor do we assume responsibility for the acts, omissions, or performance of users. All agreements for transport are between the shipper and the transporter. The Company has no control over and disclaims all liability related to: - the condition, health, legality, or welfare of animals transported, - the ability, licensing, insurance, or conduct of transporters, - the accuracy of shipper listings or representations, or - the successful completion or acceptance of any transport.
4. User Responsibilities
Shippers
Provide accurate and complete information about the animal(s), including health conditions, special needs, and legal restrictions. Ensure compliance with all animal welfare laws, including vaccinations, crates, and safe handling practices. Pay all fees and charges associated with bookings, including Platform fees and optional coverage.
Transporters
Maintain valid licensing, insurance (if applicable), and compliance with federal, state, and local laws. Provide safe, humane, and lawful animal transport. Accurately represent qualifications and availability. Agree that background checks, profile badges, or ratings provided on the Platform are informational only and do not constitute guarantees of safety or reliability.
Drivers
Maintain valid licensing, insurance (if applicable), and compliance with federal, state, and local laws. Provide safe, humane, and lawful animal transport. Complete each job as directed by your Fleet Manager, Admin, or Owner. Agree that background checks, profile badges, or ratings provided on the Platform are informational only and do not constitute guarantees of safety or reliability.
Receivers
Be available at the agreed location, date, and time to accept delivery of the animal. Inspect the animal upon delivery and promptly raise any concerns directly with the shipper and/or transporter. Comply with all applicable laws and requirements for animal ownership, including licensing, registration, and vaccinations. Acknowledge that the Company is not responsible for the condition of the animal upon delivery and does not guarantee fitness, health, or suitability of the animal received.
5. Payments, Fees, and Coverage
Payments are processed through third-party providers (such as Stripe). By booking through the Platform, you authorize us and our partners to process charges on your behalf. Platform fees are non-refundable unless otherwise stated. Optional add-on protections (“Pet Protection” or similar) may be offered at checkout. These protections are not insurance unless explicitly underwritten by a third-party insurer. The Company is not an insurer and does not guarantee reimbursement.
6. Prohibited Uses
You agree not to use the Platform for any unlawful or harmful purpose, including but not limited to: - Circumventing the Platform by arranging transports outside the Platform to avoid fees. - Listing or transporting animals that are illegal, dangerous, or restricted by law. - Engaging in fraud, misrepresentation, or providing false information. - Harassing, threatening, or abusing other users. - Attempting to hack, disrupt, or reverse-engineer the Platform. - Uploading viruses, malware, or other harmful code. Violation of this section may result in suspension or termination of your account and legal action.
7. Disputes Between Users
The Company is not responsible for disputes between shippers, transporters, drivers, or receivers. Users agree to first attempt to resolve disputes directly. The Company may, at its sole discretion, facilitate communication but is under no obligation to intervene or resolve disputes.
8. Limitation of Liability
To the fullest extent permitted by law, the Company disclaims all liability for any damages, losses, injuries, or claims arising out of or relating to: - animal injury, illness, death, loss, or escape, - delay, cancellation, or failure of transport, - user conduct, fraud, or misrepresentation, - use of optional coverage or insurance, - technical issues or interruptions of the Platform. In no event shall the Company’s total liability exceed the lesser of: (a) the amount paid by you to the Company in the six months preceding the claim, or (b) $100 USD.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising out of or related to your use of the Platform, your animals, or your transport services.
10. Termination
We may suspend or terminate your access at any time for any reason, including suspected fraud, abuse, or violation of these Terms.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Arbitration Agreement: Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Platform shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. - Arbitration shall take place in Maricopa County, Arizona. - Each party shall bear its own attorneys’ fees, unless otherwise required by law. - You waive any right to participate in class actions, consolidated actions, or jury trials. - The arbitration agreement does not preclude either party from seeking injunctive or equitable relief in a court of competent jurisdiction in Maricopa County, Arizona.
12. Modifications
We may update these Terms at any time by posting revised terms on the Platform. Continued use after such updates constitutes acceptance.
